  1. المادة 1

    No natural or legal person, including government departments and public agencies and corporations, may implement any projects, build any structures, or conduct any engineering works at the coastal zone of the Emirate of Dubai without first: a. obtaining the relevant no-objection certificate from the Dubai Municipality; and b. conducting a soil investigation to determine the type and amount of sand expected to be excavated from the soil, and notifying the Dubai Municipality of the investigation result to enable it to use the sand, that is in excess of the needs of the project, for the nourishment of erosionprone shores in the Emirate. It is prohibited to perform any excavation, backfilling, or sand dredging or transportation works without first obtaining the approval of the Dubai Municipality, regardless of the purpose of these works and whether these works are conducted within the coastal zone or between the coastal zone and other zones.

  2. المادة 2

    The coastal zone to which the provisions of this Decree apply is demarcated on the map attached hereto.

  3. المادة 3

    Without prejudice to any stricter penalty stipulated in any other legislation, a natural or legal person who violates the provisions of this Decree or the resolutions issued in pursuance hereof will be punished by a fine of no more than five hundred thousand Dirhams (AED 500,000.00), in addition to a complementary penalty commensurate with the damage caused by his violation.

  4. المادة 4

    The fines collected pursuant to Article (3) of this Decree will be paid to the Dubai Municipality.

  5. المادة 5

    Where any government department, or public agency or corporation, violates the provisions of this Decree, the Director General of the Dubai Municipality must notify His Highness the Ruler’s Court of this violation to take the appropriate action.

  6. المادة 6

    The Director General of the Dubai Municipality will issue the resolutions and instructions required for the implementation of this Decree. This includes determining the control procedures required for compliance herewith.

  7. المادة 7

    This Decree will be published in the Official Gazette and will come into force on the day on which it is published.
