Указ № (22) от 2005 года о применении электронной информационной системы агентств по прокату автомобилей

المادة 1

The following words and expressions will have the meaning indicated opposite each of them unless the context implies otherwise: Emirate: The Emirate of Dubai. DTC: The Dubai Transport Corporation. Agencies: Car rental agencies in the Emirate. System: A computer software designed for Agencies licensed in the Emirate and installed on their computers for the purpose of entering data relating to their business and activities as per the categories determined in this system. Electronic Connection: Connecting two (2) or more computers through an electronic information system or software for the purpose of exchanging information between these computers.

المادة 2

All Agencies must install and run the System on their computers, enter the required data as per the categories determined in the System, and ensure the Electronic Connection of the System to the Government departments and corporations stated in Article (4) of this Decree.

المادة 3

The Dubai Police General Headquarters will undertake technical and administrative supervision of the System, including to: 1. design the System and supervise its operation, maintenance, and upgrades; and pay any relevant expenses; 2. determine the data to be entered into the System; 3. pay charges for the telephone lines used for running the System; and 4. connect the Agencies with any Government department or public corporation or authority through the System.

المادة 4

Effective as of the date on which this Decree comes into force, the Electronic Connection of the following entities to the System will be established: 1. the Dubai Police General Headquarters; 2. the Dubai Transport Corporation; 3. the Department of Economic Development; 4. the Department of Tourism and Commerce Marketing; and 5. the Dubai Municipality. The Electronic Connection of any other Government department or public corporation or authority to the System may be established in coordination with the Dubai Police General Headquarters.

المادة 5

The DTC will charge the Agencies annual fees as prescribed in the Schedule attached to this Decree in return for installing and running the System on their computers.

المادة 6

Agencies currently based in the Emirate must comply with the provisions of Article (2) of this Decree in order to be granted a new or renewed licence.

المادة 7

The Director General of the DTC may impose the following administrative penalties on any Agency that violates the provisions of this Decree, or the regulations, bylaws, and resolutions issued in pursuance hereof: 1. a fine of no less than five hundred Dirhams (AED 500.00) and no more than ten thousand Dirhams (AED 10,000.00); and 2. temporary closure of the Agency for a period not exceeding two (2) months. Where the same violation is repeated, the Agency may be permanently closed.

المادة 8

An Agency, upon which an administrative penalty is imposed, may submit to the Board of Directors of the DTC a grievance against the decision imposing such penalty within fifteen (15) days of being notified of the same. The Board of Directors must determine the grievance within thirty (30) days of its submission. If the grievance is admitted, the Board of Directors may amend or rescind the penalty, or dismiss the grievance.

المادة 9

The Board of Directors of the DTC will issue the bylaws and resolutions required for the implementation of the provisions of this Decree.

المادة 10

This Decree will be published in the Official Gazette and will come into force two (2) months following the day on which it is published.
