المادة 1

The following words and expressions, wherever mentioned in this Resolution, will have the meaning indicated opposite each of them unless the context implies otherwise: Emirate: The Emirate of Dubai. RTA: The Roads and Transport Authority. Chairman of the Board of Directors: The chairman of the board of directors and executive director of the RTA. PTA: The Public Transport Agency. Territorial Waters: The territorial waters of the Emirate. Water Taxi: A boat accommodating eleven (11) passengers which is licensed by the PTA to transport passengers within the Territorial Waters. Station: A place designated by the PTA for passenger embarkation and disembarkation. Fare: Approved fare payable in return for transporting passengers by Water Taxis. Regular Trip: A Water Taxi trip between the Stations approved by the PTA. Tourist Trip: A Water Taxi trip which has no chartered route or Station.

المادة 2

The PTA will have the duties and powers to: 1. conduct detailed studies and adopt the practices required to design, build, operate, maintain, and manage Water Taxis; 2. operate Water Taxis and manage Stations within the Territorial Waters, and supervise and audit maintenance facilities and wharfages; 3. license Water Taxi operators and determine the allowed speed limits in coordination with the concerned entities in the Emirate; 4. determine the operating hours of Water Taxis and Stations; 5. buy, sell, own, and charter Water Taxis; 6. construct, own, equip, take lease of, and lease out maintenance and repair workshops; 7. enter into agreements and partnerships with corporations, companies, and authorities to cooperate in the field of passenger transport by Water Taxi; and 8. buy, own, and take lease of floating offices for the purpose of the operating and maintaining Water Taxis.

المادة 3

a. Use of Water Taxi will be in return for a Fare determined as follows: 1. Regular Trip: Fare determined in accordance with Schedule (1) attached hereto; or 2. Tourist Trip: Four hundred Dirhams (AED 400.00) per hour. b. The PTA will determine the methods of collecting the Fare referred to in paragraph (a) of this Article, the categories eligible for discounts, and the applicable discount rates. c. The RTA may, in accordance with the rules and standards it adopts, determine the Fare for trips between Stations to be constructed after the effective date of this Resolution based on the initial scheme adopted to determine the Fare of the trips as stated in Schedule (1) attached hereto.

المادة 4

The Chairman of the Board of Directors may authorise any corporation or company to operate Water Taxis in return for an annual fee determined under an agreement to be concluded for this purpose. This agreement will provide for the obligations and the duties of the parties.

المادة 5

For the purpose of safe and optimal use of Water Taxis, the RTA will issue the bylaws and instructions regulating the use of Water Taxis and Stations, including all relevant rules, requirements, and conditions, in addition to means of ensuring the safety of Water Taxi users.

المادة 6

In addition to the penalty of a fine prescribed under this Resolution, a violating party will be liable for compensation for any damage to a Water Taxi, equipment, devices, or Stations, in addition to a twenty five percent (25%) of the amount of damages as administrative fees. The RTA assessment of such damages will be final.

المادة 7

a. Without prejudice to any stricter penalty stipulated in any other legislation, a person who violates any of the provisions of this Resolution, its implementing bylaw, or the instructions issued in pursuance hereof, will be punished by the fine prescribed for such violation in Schedule (2) or Schedule (3) attached hereto. b. The PTA may, in addition to imposing the penalty of a fine stipulated in paragraph (a) of this Article, suspend the operation of a Water Taxi for a period not exceeding one (1) month.

المادة 8

The employees and inspectors of the RTA nominated pursuant to a resolution of the Chairman of the Board of Directors will have the capacity of law enforcement officers to record the acts committed in breach of the provisions of this Resolution, its implementing bylaw, or the instructions issued in pursuance hereof. For this purpose, they may issue the necessary violation reports and seek assistance from police personnel.

المادة 9

The charges and fines collected pursuant to this Resolution will be paid to the Public Treasury of the Government of Dubai.

المادة 10

The Chairman of the Board of Directors will issue the bylaws and instructions required for the implementation of the provisions of this Resolution.

المادة 11

This Resolution comes into force on the day on which it is issued, and will be published in the Official Gazette.
