المادة 1

This Law will be cited as “Law No. (22) of 2006 Concerning the Traffic Toll in the Emirate of Dubai”.

المادة 2

The following words and expressions, wherever mentioned in this Law, will have the meaning indicated opposite each of them unless the context implies otherwise: Emirate: The Emirate of Dubai. Executive Council: The Executive Council of the Emirate of Dubai. RTA: The Roads and Transport Authority. Board of Directors: The board of directors of the RTA. Executive Director: The executive director of the RTA. Agency: The Traffic and Roads Agency of the RTA. Vehicle Owner: A person in whose name a Vehicle is registered, including the person who drives it. Peak Hours: The hours during which Road traffic is at its heaviest, and which are determined in accordance with the technical standards and guidelines adopted by the RTA. Traffic Toll: The amount paid by a Road User upon passing through a Traffic Toll Gate. Traffic Toll Gates: The locations where special technical equipment is installed, allowing the approved Traffic Toll to be deducted from the Tag of any Vehicle passing through these locations without the need to stop the Vehicle. Tag: A card on which all Vehicle information is stored, which is affixed to a Vehicle and enables Traffic Toll Gate equipment to deduct the Traffic Toll approved for Traffic Toll Gates without the need to stop the Vehicle.

المادة 3

The RTA will charge motor Vehicle Owners whose Vehicles use the Road network of the Emirate and pass through a Traffic Toll Gate in one direction a “Traffic Toll Fee”, whether or not the Vehicle is registered in the Emirate.

المادة 4

For the purposes of this Law, motor Vehicles are categorised into: 1. motorcycles; 2. light Vehicles (private/public) 3. heavy Vehicles; 4. light buses; 5. heavy buses; 6. light motorised machines; and 7. heavy motorised machines.

المادة 5

Vehicle Owners must ensure that the motor Vehicles mentioned in Article (4) above do not pass through Traffic Toll Gates without first having the Tag affixed to their Vehicles in accordance with the rules and conditions stipulated in this Law.

المادة 6

Vehicle Owners whose motor Vehicles pass through Traffic Toll Gates in the Emirate must obtain Tags and affix them to their designated places on the Vehicles.

المادة 7

For the purposes of this Law, the RTA will be solely responsible for setting and adopting the technical requirements, standards, and guidelines for determining the locations of Traffic Toll Gates on the streets and Roads in the Emirate, and for determining the Peak Hours, and Traffic Toll Gate operation timings.

المادة 8

The Traffic Toll Gate site plans (1), (2), and (3) attached to this Law are hereby approved. The Executive Director may remove or relocate any of the approved Traffic Toll Gates or add any other Traffic Toll Gate in line with the traffic flow and the safety of Road Users in the Emirate.

المادة 9

The Agency will determine the types of motor Vehicles which are permitted, and those that are not permitted, to pass through Traffic Toll Gates. Relevant information signs must be placed at the entrance of Traffic Toll Gates.

المادة 10

This Law will not apply to the following motor Vehicles: 1. Vehicles registered with the Armed Forces carrying its number plates and logos; 2. Vehicles of the Police and Civil Defence carrying their number plates and logos; 3. Vehicles dedicated to transporting students of schools, institutes, or universities; 4. public transport buses of the RTA; and 5. Vehicles that are exempted by a resolution of the Executive Director.

المادة 11

Employees and inspectors of the RTA nominated by a resolution issued by the Executive Director will have the capacity of law enforcement officers to record the acts committed in breach of the provisions of this Law, its implementing bylaw, and the resolutions issued in pursuance hereof. For this purpose, they may issue the necessary violation reports and fines.

المادة 12

The Agency may estimate the value of compensation for any damage to Traffic Toll Gate operating systems, including the administrative costs.

المادة 13

Without prejudice to any stricter penalty stipulated in any other legislation, a person who violates the provisions of this Law or its implementing bylaw will be punished by a fine of not less than five hundred Dirhams (AED 500.00) and not more than ten thousand Dirhams (AED 10,000.00). Upon repetition of the same violation within one (1) year, the amount of the fine will be doubled.

المادة 14

For the purpose of implementing this Law and its implementing bylaw, the Agency may seek the assistance of Government departments, authorities, and public corporation, including police personnel.

المادة 15

1. The Executive Council will approve the fees and fines related to the implementation of this Law by issuing a resolution upon the approval of the Department of Finance and the RTA of these fees and fines. 2. The Board of Directors may increase the Traffic Toll fee provided that it does not exceed the approved fee.

المادة 16

All the fees and fines referred to in Article (15) will be paid to the RTA.

المادة 17

The Executive Director will issue the implementing bylaw and the resolutions required for the implementation of this Law.

المادة 18

Any provision in any other legislation will be repealed to the extent that it contradicts the provisions of this Law.

المادة 19

This Law will be published in the Official Gazette and will come into force on 1 July 2007.
