Cheque Bounce UAE: What Happens If Yours Fails
If you're staring at a returned cheque and wondering whether the police are about to knock, take a breath. The law changed in 2022, and cheque bounce UAE cases now work very differently from what your uncle warned you about.
Quick answer
A bounced cheque in the UAE is no longer an automatic criminal case. Under Federal Decree-Law No. 14 of 2020 (in force since 2 January 2022), a partially funded cheque must be paid to the extent of available funds by the drawee bank, and the bounced portion becomes directly enforceable as an executive instrument — meaning the holder skips the criminal complaint and goes straight to civil execution at the court. Criminal liability still exists, but only in narrower scenarios: closing the account before payment, ordering the bank to stop payment without cause, signing knowing there aren't funds, or issuing a cheque that isn't drawable.[1][2]
What the bank actually does now
The drawee bank has to pay whatever is in the account, even if it's less than the cheque amount. This is the big shift. The holder then gets a formal certificate showing the shortfall, and that certificate is an executive title.[1]
So if you're the recipient of a partially bounced cheque, you don't need a criminal complaint to start recovering. You take the cheque and the bank's non-payment certificate to the execution court and enforce it like a court judgment.
If you're the drawer? Assume the money is coming out one way or another. Stalling doesn't help.
When cheque bounce UAE cases are still criminal
Article 675 of the amended Commercial Transactions Law kept criminal penalties for the deliberate stuff. You can still face fines — and in serious cases, imprisonment — if you:[2][3]
- Withdraw all funds before the cheque is presented, making payment impossible
- Order the bank to stop payment for reasons other than loss, theft, or the beneficiary's bankruptcy
- Close the account or block it before the cheque clears
- Sign a cheque you know can't be drawn (e.g., unsigned counterparty, wrong account)
- Deliberately write or sign the cheque in a way that prevents it from being paid
Penalties range from AED 1,000 to AED 100,000 depending on the cheque amount, plus potential trade-name restrictions and, for repeat or aggravated cases, custodial sentences. The Public Prosecution can also issue penal orders for smaller amounts without a full trial.[2][3]
Honestly, most bounced cheques now don't hit any of these triggers. They're just insufficient funds — and that's a civil enforcement matter.
Watch out: giving a post-dated cheque as "security" doesn't shield you. If it bounces on the date written, the same rules apply. The 2022 amendments removed the old "cheque as guarantee" defence that used to work in some Dubai courts.
What to do if you're the holder
Present the cheque. If it bounces — fully or partially — the bank issues a return memo stating the reason. Keep the original cheque and that memo. Together they're your executive instrument.
File for execution at the competent court (Dubai Courts, Abu Dhabi Judicial Department, or the relevant emirate's court). No criminal complaint needed to recover the money. Execution can freeze accounts, place travel bans, and attach assets.[1]
You can still file a criminal complaint at the police station if the drawer's conduct fits one of the Article 675 categories above. Do it within the limitation period, and bring the cheque, return memo, and any evidence of the drawer's intent.
What to do if you're the drawer
Pay. Sooner is cheaper than later.
If the cheque was partially covered and the bank paid what it could, arrange to settle the remaining amount directly with the holder and get a written acknowledgment. Once satisfied, the holder should file to close the execution file. If a criminal case has been opened, settlement at any stage — even after conviction — stops enforcement of the penalty under Article 676 of the amended law.[2]
Ignoring it invites a travel ban, frozen accounts, and a garnishment on your salary through the courts. For business owners, expect the same on company accounts if the cheque was corporate.
