المادة 1

The following words and expressions, wherever mentioned in this Resolution, will have the meaning indicated opposite each of them unless the context implies otherwise: UAE: The United Arab Emirates. Emirate: The Emirate of Dubai. Law: Law No. (11) of 2010 Concerning the Licensing of Vessels in the Emirate of Dubai. Executive Council: The Executive Council of the Emirate of Dubai. RTA: The Roads and Transport Authority. DMCA: The Dubai Maritime City Authority. Executive Director: The executive director of the DMCA. Maritime Activities: This includes without limitation Maritime Transport, inspections of Vessels, maritime safety, teaching and training on how to navigate Vessels, training on diving, training on water sports, and on other Maritime Activities which are authorised in the Emirate in accordance with the Law, this Resolution, and the resolutions issued in pursuance thereof. Vessel: Any vessel of any type or structure whatsoever operated on the Waters of the Emirate to transport Passengers or Goods for personal, commercial, sports, or tourism purposes. Establishment: A company or sole proprietorship licensed to conduct any of the Maritime Activities in accordance with the legislation in force in the Emirate. Licence: A document issued by the DMCA in accordance with the Law, this Resolution, and the resolutions issued in pursuance thereof, which authorises a Vessel to navigate on the Waters of the Emirate. Permit: A document issued by the DMCA in accordance with the requirements and rules stipulated in the Law, this Resolution, and the resolutions issued in pursuance thereof, to a Master, Seaman, Pilot, or any person working on board a Vessel or conducting Maritime Activities, which authorises him to navigate, work on-board, or pilot Vessels, or to train others on navigating or piloting Vessels. Authorisation: A document issued by the DMCA authorising an Establishment to conduct Maritime Activities on the Waters of the Emirate. Merchant Ship: A high-tonnage ship built and operated in compliance with international maritime treaties. Maritime Transport: An activity that involves transporting Passengers or Goods, for a fare, from one place to another within the Waters of the Emirate using a Vessel. Group Maritime Transport: An activity that involves group transport of Passengers, for a fare, from one place to another within the Waters of the Emirate using a Vessel. Passenger: Any person using a Vessel to travel from one place to another within the Emirate. Goods: Any livestock, agricultural, or industrial materials, equipment, or things; raw materials; or other materials, whether in liquid, solid, or gaseous state, which are transported by a Vessel within the Emirate. Master: A natural person authorised by the DMCA to operate and supervise the operation and management of a Vessel. Pilot: A natural person who is authorised by the DMCA to guide Vessels to take a safe passage when entering or exiting ports. Seaman: A natural person authorised by the DMCA to work on board a Vessel. Marine Engine Operator: A natural person authorised by the DMCA to conduct mechanical maintenance works on board a Vessel. Marine Electrician: A natural person authorised by the DMCA to conduct electrical maintenance works on board a Vessel. Nokhada: A natural person authorised by the DMCA to navigate a fishing Vessel. Captain: A natural person authorised by the DMCA to navigate a Vessel of a Government Entity. Trainer: A natural person authorised by the DMCA to train others on navigating Vessels, on water sports, on diving, on maritime safety, or on maritime education. Maritime Inspector: A natural person authorised by the DMCA to inspect Vessels. Register: A paper or electronic record maintained by the DMCA of the Vessels which are licensed for use in the Emirate. Registration: The record entered by the DMCA in the Register, in accordance with the Law, this Resolution, and the resolutions issued in pursuance thereof, to document ownership of a Vessel. Waters of the Emirate: The waters of the Emirate of Dubai lying between the Dubai-Sharjah border and the Dubai-Abu Dhabi border and extending to the exclusive economic zone, including the internal Waters of the Emirate, sea ports, marinas, canals, and waterways. Prohibited Areas: Areas demarcated by the DMCA and concerned entities in the Emirate where the use of Vessels is prohibited. Harbour: Vessel anchorage and berthing facilities,, including marinas, marine sports clubs, fishing ports, private ports, marine stations, and permanent or temporary berths in the Waters of the Emirate. Merchant Ship Anchorage: Merchant Ship anchorage facilities located outside ports and within the Waters of the Emirate. Minimum Safe Manning Document: A document issued by the DMCA which contains the minimum number of crew members required to safely manage and operate a Vessel. Kilowatt: A measurement unit of the propulsion power of the main engines of a Vessel. Gross Ton: A measurement unit of the total weight capacity of a Vessel expressed in tons.

المادة 2

a. Without prejudice to applicable legislation in the Emirate and international maritime treaties and conventions to which the UAE or the Emirate is a party, this Resolution will apply to: 1. Vessels navigating the Waters of the Emirate; and 2. entities and individuals conducting any Maritime Activity in the Emirate relating to using, navigating, piloting, working on board, or training the crew members of a Vessel or related to chartering or transportation by a Vessel or any other related activity. b. Except for provisions related to security, safety, and environmental requirements applicable to Vessels, the following Vessels will be exempt from the Registration and licensing provisions stipulated in this Resolution: 1. Vessels owned by the DMCA, the Armed Forces, the Civil Defence, and the Dubai Police; 2. Vessels registered and licensed outside of the Emirate and authorised to enter the Emirate; and 3. other Vessels determined pursuant to a solution of the Chairman of the Executive Council.

المادة 3

Vessels which are registered and licensed by the DMCA are divided into the following four (4) categories: a. Commercial Vessels: Vessels intended for conducting business including but not limited to: 1. Charter Vessels; 2. Vessels operating in the ports of the Emirate; 3. Vessels used for construction purposes; 4. Vessels used for towing and piloting; 5. Passenger Vessels; and 6. Vessels used for transporting Goods. b. Recreational Vessels: Vessels intended for personal use including, but not limited to: 1. Motorised Recreational Vessels, including: - Vessels less than twelve (12) metres in length; - Vessels between twelve (12) and twenty-four (24) metres in length; and - Vessels more than twenty-four (24) metres in length. 2. Non-motorised Recreational Vessels, including: - rowing boats; and - sailing boats and similar Vessels. c. Sports Vessels: Vessels designated for conducting water sports including, but not limited to, the following Vessels and similar Vessels: 1. personal watercraft; 2. electric surfboards; 3. water vehicles; 4. hovercraft; 5. small electric boats; and 6. small petrol boats. d. Traditional Wooden Vessels: Vessels made primarily of wood including, without limitation, small passenger boats (Abras), wooden floating restaurants, wooden tourist boats, and similar Vessels.

يلغى أي نص في أي قرار آخر إلى المدى الذي يتعارض فيه وأحكام هذا القرار.

ينشر هذا القرار في الجريدة الرسمية، ويعمل به من تاريخ نشره.

المادة 9

A Licence application will be submitted to the DMCA on the form prescribed by the DMCA for this purpose, supported by the following documents: 1. a copy of the shipbuilder’s certificate of the Vessel; 2. a valid technical inspection pass report of the Vessel issued by the DMCA or an entity approved by the DMCA; 3. a copy of the ownership document of the Vessel to be licensed; 4. a copy of the de-registration document of the Vessel in the last jurisdiction where it was registered in case of second-hand Vessels, and proof there is no lien, finance lease, or any other encumbrance on the Vessel; 5. a copy of the customs clearance certificate issued by the competent entities in the UAE, in case of Vessels imported from outside of the UAE; 6. for UAE nationals, a copy of the family book (Khulasat Qaid) and passport or Emirates identity card ; and for non-UAE nationals, a copy of the passport and a valid UAE residence permit or Emirates identity card; 7. a copy of the valid commercial licence, if the owner of the Vessel is a legal person; 8. a copy of the insurance policy of the Vessel , issued by an insurance company licensed to operate in the UAE as a Vessel insurance provider, or by any other entity approved by the DMCA. The insurance policy must be valid throughout the validity of the Licence; 9. a copy of the radio licence; 10. a copy of the Vessel mortgage agreement concluded by its owner and the mortgagee if the Vessel is mortgaged in the UAE; and 11. any other document required pursuant to the resolutions and instructions issued by the DMCA in this respect.

المادة 12

A Licence renewal application will be submitted to the DMCA on the form prescribed by the DMCA for this purpose, supported by the following documents: 1. a valid technical inspection pass report of the Vessel issued by the DMCA or any entity approved by the DMCA; 2. for UAE nationals, a copy of the family book (Khulasat Qaid) and passport or Emirates identity card; and for non-UAE nationals, a copy of the passport and a valid UAE residence permit or Emirates identity card; 3. a copy of the valid commercial licence, if the owner of the vehicle is a legal person; 4. a copy of the insurance policy of the Vessel, issued by an insurance company licensed to operate in the UAE as a Vessel insurance provider, or by any other entity approved by the DMCA. The insurance policy must be valid throughout the validity of the Licence; 5. a copy of the radio licence; and 6. any other document required pursuant to the resolutions and instructions issued by the DMCA in this respect.

المادة 15

An application for variation of the Licence details will be submitted to the DMCA on the form prescribed by the DMCA for this purpose, supported by the following documents: 1. the original Licence; 2. a copy of the Vessel modification authorisation issued by the DMCA in the event of making a modification to the Vessel;

المادة 23

أ- يجب على مالك الوسيلة البحرّية أو الرّبان إخطار السلطة فوراً بأي عطل أو خلل في الوسيلة البحرّية أو أجهزتها قد يؤّثر على سالمة رّكابها أو صالحيتها لإلبحار، على أن يتضمن هذا اإلخطار بيان طبيعة ذلك العطل أو الخلل وحجمه ومسبباته. ب- في حال هالك الوسيلة البحرّية ألي سبب كان أو فقدها أو سرقتها، فإنه يجب على مالك الوسيلة البحرّية أو الرّبان إخطار السلطة فوراً بذلك، واعادة الترخيص األصلي إليها إن أمكن ذلك، لتتولى السلطة إجراء تحقيق فني في الحادث واعداد تقرير في هذا الشأن، ليتم على أساسه شطب الوسيلة البحرّية من السجل والغاء الترخيص، وذلك مع عدم اإلخالل بحقوق الغير.

المادة 24

يجوز للوسيلة البحرّية األجنبية الزائرة اإلبحار في مياه اإلمارة ألغراض النّزهة أو ألي غرض آخر، متى كانت مستأجرة من قبل جهة مرّخص لها بالعمل في اإلمارة، شريطة حصول هذه الوسيلة البحرّية على تصريح بذلك من السلطة، وتكون مّدة هذا التصريح على النحو التالي: 1. ستة (6) أشهر قابلة للتجديد في حال كانت الوسيلة البحرّية األجنبية الزائرة ستبحر في مياه اإلمارة ألغراض النّزهة. 2. ستة (6) أشهر غير قابلة للتجديد في حال كانت الوسيلة البحرّية األجنبية الزائرة مستأجرة.

المادة 29

أ- تحدد شروط منح الرخصة للعاملين على الوسيلة البحرّية بحسب نوع الوسيلة البحرّية، ووفقاً لما يلي: 1. وسيلة النزهة البحرية: يشترط في الشخص الطبيعي الذي يرغب في الحصول على رخصة قيادة هذه الوسيلة البحرّية ما يلي: أ- أال يقل عمره عن (16) ست عشرة سنة. ب- أن يجتاز الدورات التأهيلية التي تحددها السلطة للحصول على رخصة قيادة هذا النوع من الوسائل البحرّية. ج- أن يجتاز الفحوصات الطبية المقررة من السلطة لهذه الغاية. د- أن يكون ملّماً بقواعد المالحة البحرّية المحلّية. ه- أي شروط أخرى تحددها السلطة بموجب القرارات والتعليمات الصادرة عنها في هذا الشأن. 2. الوسيلة البحرّية التجارية التي تقل حمولتها عن (500) طن كّلي، ويقّسم العاملون على هذه الوسيلة البحرّية إلى فئتين أساسيتين، وهما: أ- فئة المالحة البحرّية، وتستند هذه الفئة إلى الشهادات العلمية التي تؤهلهم لشغل الوظائف التالية: 1. الرّبان: الشخص الطبيعي المسؤول عن الوسيلة البحرّية التجارّية. 2. الضابط البحري المساعد للرّبان: الشخص الطبيعي المسؤول على متن الوسيلة البحرّية التجارّية. 3. البحار: الشخص الطبيعي المكلّف من الرّبان بالقيام بأي أعمال على متن الوسيلة البحرّية التجارّية، بما في ذلك أعمال المناوبة البحرّية. ب- فئة الهندسة البحرّية: وتستند شهادات البحارة الذين يقومون بمهام الهندسة البحرّية على قدرة محرك الوسيلة البحرّية، وتخّول هذه الشهادات حاملها لشغل الوظائف التالية: 1. مشغل محرك بحري (3000) كيلوواط، ويكون مسؤوالً عن مشغل محركات الدفع البحرّية التي ال تزيد قدرتها على (3000) كيلوواط. 2. مشغل محرك بحري (1500) كيلوواط، ويكون مسؤوالً عن مشغل محركات الدفع البحرّية التي ال تزيد قدرتها على (1500) كيلوواط. 3. مشغل محرك بحري (750) كيلوواط، ويكون مسؤوالً عن مشغل محركات الدفع البحرّية التي ال تزيد قدرتها على (750) كيلوواط. 4. مساعد مشغل محرك بحري (3000) كيلوواط، ويكون مساعداً لتشغيل محركات الدفع البحرّية التي ال تزيد قدرتها على (3000) كيلوواط. 5. مساعد مشغل محرك بحري (1500) كيلوواط، ويكون مساعداً لتشغيل محركات الدفع البحرّية التي ال تزيد قدرتها على (1500) كيلوواط. 6. كهربائي بحري، ويكون مسؤوالً عن أعمال الصيانة الكهربائية على متن الوسيلة البحرّية. 3. الوسيلة البحرّية الخشبية التقليدية: هي الوسيلة البحرّية التي تعتمد في تشغيلها على وجود الرّبان والبحارة ممن يجب عليهم االلتزام بمواصفات الكفاءة الواجب توفرها في العاملين على الوسائل البحرّية التجارّية، وذلك فيما عدا رّبان العبرة الذي يتوجب عليه الحصول على رخصة قيادة عبرة، وفقاً للشروط المعتمدة لدى السلطة في هذا الشأن. ب- يشترط ليكون الشخص الطبيعي مؤهالً للحصول على الرخصة أو تصريح للعمل على الوسيلة البحرية، توفر ما يلي: 1. أال يقل سنه عن السن الذي تحدده السلطة لقيادة الوسيلة البحرّية. 2. أن يجتاز الدورات التأهيلية التي تحددها السلطة للحصول على الرخصة. 3. أن يجتاز الفحوصات الطبية المقررة من السلطة لهذه الغاية. 4. أي شروط أخرى تحددها السلطة بموجب القرارات والتعليمات الصادرة عنها في هذا الشأن. ج- يشترط لمنح الرخصة للمرشد البحري، ما يلي: 1. أال يقل سنه عن السن الذي تحدده السلطة. 2. أن يجتاز الدورات التأهيلية التي تحددها السلطة للحصول على الرخصة. 3. أن يجتاز الفحوصات الطبية المقررة من السلطة لهذه الغاية. 4. أي شروط أخرى تحددها السلطة بموجب القرارات والتعليمات الصادرة عنها في هذا الشأن. د- يجوز للسلطة منح الرخصة لمواطني الدولة أو المقيمين فيها ممن يحملون رخصة صادرة عن أي دولة أخرى، متى تبين للسلطة أن هذه الرخصة تتفق مع االشتراطات والمتطلّبات المعتمدة لديها.

المادة 30

أ- تكون مّدة صالحية الرخصة (5) خمس سنوات، ويجوز تجديدها لمدد مماثلة. ب- على الرغم مّما ورد في الفقرة (أ) من هذه المادة، يجوز للسلطة إصدار رخصة لقيادة الوسيلة البحرّية أو العمل عليها أو التدريب على قيادتها لمّدة ال تزيد على (3) ثالثة أشهر، وفقاً للشروط والمتطّلبات التي يصدر بتحديدها قرار من المدير التنفيذي في هذا الشأن. ج- تعتبر الرخصة الصادرة وفقاً ألحكام الفقرة (أ) من هذه المادة ملغاة، في حال عدم تجديدها خالل سنة واحدة من تاريخ انتهائها.

المادة 33

يجوز للسلطة سحب الرخصة لمّدة ال تزيد على (6) ستة أشهر أو إلغاؤها، إذا خالف حاملها أحكام القانون وهذا القرار والقرارات الصادرة بموجبهما، ويجب على من تم سحب رخصته أو إلغاؤها تسليمها للسلطة بشكل فوري.

المادة 35

أ- ال يجوز ألي شخص طبيعي أو اعتباري أن يقوم بتدريب أي شخص على أي نشاط بحري، ما لم يكن مرّخصاً له بذلك من السلطة. ب- يتم التصريح للمنشأة بمزاولة األنشطة البحرّية بالتنسيق مع الجهات المختصة في اإلمارة، بما في ذلك الجهات المعنية بمنح الرخص التجارّية.

المادة 52

أ- تصدر السلطة بالتنسيق مع الجهات الحكومية المعنية في اإلمارة، القرارات والتعليمات الالزمة لتنفيذ أحكام القانون وهذا القرار، وعلى وجه الخصوص ما يلي: 1. المعايير واالشتراطات المتعلّقة بأنظمة السالمة للوسائل البحرّية ومعّداتها، للتأكد من مدى صالحيتها لالستخدام، ومطابقتها لالشتراطات البيئية. 2. تنظيم أماكن رسو وايواء الوسائل البحرّية في مياه اإلمارة. 3. تنظيم إدارة وتشغيل مراسي الوسائل البحرّية واألندية الرّياضية البحرّية في اإلمارة. 4. تحديد الخطوط الرئيسة لشبكة النّقل البحري في اإلمارة، وتحديد المسارات والمواقع التي يصرح أو يحظر ممارسة األنشطة البحرّية المختلفة فيها. 5. تحديد السرعات المصّرح بها. 6. تنظيم منشآت السكن العائم، التي تستخدم لإلقامة في مياه اإلمارة، وتشمل البيوت والفنادق والمطاعم العائمة والوسائل البحرّية المخصصة لذلك، على أن يحدد القرار الصادر في هذا الشأن الشروط واإلجراءات الالزمة لترخيص تلك المنشآت. ب- للسلطة اقتراح إصدار أي تشريعات تكون الزمة لتنفيذ أحكام أي معاهدة أو اتفاقية بحرية دولية تكون الدولة طرفاً فيها، وذلك فيما يتصل أو يتعّلق بتنفيذ أي من أحكام القانون وهذا القرار.
