Law No. (12) of 2024 Concerning the Sashes, Decorations, Medals, and Badges of Mohammed bin Rashid Al Maktoum

المادة 1

This Law will be cited as “Law No. (12) of 2024 Concerning the Sashes, Decorations, Medals, and Badges of Mohammed bin Rashid Al Maktoum”.

المادة 2

The following words and expressions, wherever mentioned in this Law, will have the meaning indicated opposite each of them unless the context implies otherwise: UAE: The United Arab Emirates. Emirate: The Emirate of Dubai. Ruler: His Highness the Ruler of Dubai. Crown Prince: The Crown Prince of the Emirate. EO: The Executive Office of the Ruler. Chairman: The chairman of the EO. Sash: A form of recognition represented by a special band worn around the neck or across the uniform, featuring a precious metal piece affixed to it. It signifies the highest degree of recognition and appreciation awarded by the Ruler pursuant to the provisions of this Law. Decoration: A form of recognition represented by a metal piece of various shapes made of a precious material and attached to a special ribbon, worn around the neck or on the uniform. It signifies a degree of recognition and appreciation awarded by the Ruler pursuant to the provisions of this Law. Medal: A form of recognition represented by a piece of metal of various shapes. It signifies a degree of recognition and appreciation awarded by the Awarding Body pursuant to the provisions of this Law. Badge: A form of recognition represented by an insignia, shield, emblem, or a special award, available in various shapes. It is considered a degree of recognition and appreciation awarded by the Awarding Body pursuant to the provisions of this Law. Certificate of Recognition: An official document signed by the Awarding Body, which clearly states the name of the Awarding Body, the name of the recipient, the type of recognition awarded, the reason for the award, the date on which the recognition is awarded, and other relevant details. Awarding Body: This includes the Ruler, the Crown Prince, or the deputies to the Ruler, as prescribed under this Law. General Secretariat: An organisational unit, within the EO, in charge of supervising the awarding of Sashes, Decorations, Medals, Badges, and the respective Certificates of Recognition in accordance with the conditions, rules, and regulations stipulated in this Law and the resolutions issued in pursuance hereof.

المادة 3

a. The following Sashes, Decorations, Medals, and Badges are hereby introduced in the Emirate: 1. the Mohammed bin Rashid Al Maktoum Sash; 2. the Mohammed bin Rashid Al Maktoum Decoration; 3. the Mohammed bin Rashid Al Maktoum Medal; and 4. the Mohammed bin Rashid Al Maktoum Badge. b. New Sashes, Decorations, Medals, Badges, or any other forms and types of recognition may be introduced pursuant to a resolution of the Ruler. c. Subject to the provisions of federal laws or federal laws by decrees, no federal or local entity in the UAE may issue, introduce, distribute, or award any Sashes, Decorations, Medals, Badges, or any other forms of recognition in the name of the Ruler or in any other official capacity he holds within or outside of the UAE, without first coordinating with the EO and obtaining its approval. d. The provisions of this Law apply without prejudice to any other legislation governing the awarding of any type of Decoration, Badge, or Medal, particularly the provisions of the above-mentioned Law No. (10) of 1997.

المادة 4

a. The General Secretariat will prepare a list classifying, and determining the categories and rules for awarding, Sashes, Decorations, Medals, and Badges. The EO will then submit this list to the Ruler for approval. b. The recognition awarded under this Law will be classified into the following four (4) categories: 1. First Category: Meritorious Achievements and Services: This category is awarded to individuals, establishments, and companies within the Emirate in recognition of their loyalty to the UAE and the Emirate, and of their meritorious role and contribution to its growth and advancement. 2. Second Category: Humanitarian and Charitable Work: This category is awarded to individuals, organisations, and companies in recognition of their significant roles and outstanding contributions to charitable, humanitarian, and voluntary work; for establishing charitable associations and foundations, and endowments; and for making substantial donations in support of these causes. 3. Third Category: Scientific Research: This category is awarded to distinguished scientists and researchers in specialised scientific fields, holders of higher academic degrees, and to universities and other educational institutions, in recognition of their outstanding scientific contributions at the international level. 4. Fourth Category: Culture, Sports, and Arts: This category is awarded to individuals, establishments, and companies in recognition of their significant contributions in the fields of culture, sports, arts, and innovation that enrich and invigorate the cultural, artistic, and sports landscape of the Emirate. c. Sashes, Decorations, Medals, and Badges may, pursuant to a resolution of the Ruler, be awarded to any individual, establishment, or company other than those specified in the categories mentioned in paragraph (b) of this Article.

المادة 5

a. The Sashes, Decorations, Medals, Badges, and other forms of recognition awarded under this Law by an Awarding Body are hereby deemed the property of the Emirate, including the intellectual property rights in the associated artworks, designs, and figures. These Sashes, Decorations, Medals, Badges may only be manufactured by the entities approved by the EO. b. The Sashes, Decorations, Medals, Badges, and other forms of recognition awarded under this Law may not be disposed of in any manner that involves the transfer of ownership or possession, and they may not be pledged or seized. Any disposition undertaken in breach of the provisions of this Law will be null and void.

المادة 6

a. A Sash, Decoration, or Medal will be awarded along with the corresponding Certificate of Recognition by the Ruler. The Ruler, the Crown Prince, either of the deputies to the Ruler, or any of their authorised representatives will award these Sashes, Decorations, and Medals. b. A Badge will be awarded along with the corresponding Certificate by the Awarding Body or by a resolution of the Chairman, upon the recommendation of the General Secretariat and in coordination with the concerned entities in the Emirate. The Ruler, the Crown Prince, either of the deputies to the Ruler, or any of their authorised representatives will bestow these Badges. c. Sashes, Decorations, Medals, and Badges will be bestowed during national celebrations and official festivities; during official overseas visits by the Ruler, the Crown Prince, or either of the deputies to the Ruler; during visits to the Emirate by the individuals to be recognised; or during any other special occasion as required.

المادة 7

a. Any individual who is awarded a Sash, Decoration, Medal, or Badge will receive a Certificate of Recognition bearing the signature of the Awarding Body. b. A natural or legal person to whom a Sash, Decoration, Medal, or Badge is awarded will retain ownership thereof, unless it is withdrawn or revoked in accordance with the provisions of Article (11) of this Law. The recipient's universal or particular successors may retain the Sash, Decoration, Medal, or Badge as a keepsake, without having the right to wear it.

المادة 8

a. For the purposes of this Law, the EO is the competent Government Entity in the Emirate exclusively responsible for overseeing the process of manufacturing Sashes, Decorations, Medals, and Badges to be awarded in accordance with the provisions of this Law; for their safekeeping and maintenance; and for receiving and preserving any recovered items, in accordance with the policies and procedures approved by the Chairman in this respect. b. Notwithstanding the provisions of any other legislation, the EO will act as the legal representative in respect of the Sashes, Decorations, Medals, Badges, and other forms of recognition awarded under this Law. In this capacity, the EO will have the right to take the necessary legal action to preserve the associated rights and to file the relevant civil and criminal lawsuits.

المادة 9

a. Pursuant to this Law, an organisational unit named the “General Secretariat for the Mohammed bin Rashid Al Maktoum Decorations” (the "General Secretariat") is established at the EO. The General Secretariat is hereby incorporated into the organisational structure of the EO. b. The General Secretariat will have the duties and powers to: 1. conduct studies and research on the individuals, establishments, and companies eligible for any of the degrees of recognition stipulated in this Law; 2. prepare, in coordination with the concerned entities in the Emirate, a list of nominees for the Sashes, Decorations, Medals, Badges, and any other forms of recognition, and the financial remuneration to which they are entitled, in accordance with the policies and procedures approved by the EO; and present the same to the Chairman for approval, prior to its final approval by the Ruler; 3. prepare proposals for the designs, drawings, specifications, measurements, and weights of the Sashes, Decorations, Medals, and Badges, and any other types of recognition, and present these to the Chairman for approval, prior to their final approval by the Ruler; 4. develop the policies, procedures, bylaws, rules, and controls for introducing or awarding Sashes, Decorations, Medals, Badges, and any other forms of recognition and for determining the frequency of their awarding; and any other relevant provisions; and submit the same to the Chairman for approval; and 5. exercise any other duties or powers assigned to the General Secretariat by the Ruler, the Crown Prince, the deputies to the Ruler, or the Chairman.

المادة 10

a. The General Secretariat will maintain a register that contains the types and categories of the Sashes, Decorations, Medals, and Badges; the names and details of the individuals and entities to whom they are awarded; the numbers of the Certificates of Recognition issued to them; the corresponding remuneration; and any changes made thereto. This register will be maintained and managed in accordance with the policies and procedures approved by the Chairman in this respect. b. The details of the Sashes and Decorations awarded by the Ruler prior to the effective date of this Law, and which fall within the categories referred to in Article (4) hereof, will be recorded in the register referred to in paragraph (a) of this Article. c. The individuals awarded Sashes, Decorations, Medals, or Badges before the effective date of this Law will retain them. The General Secretariat must record the relevant details in the register referred to in paragraph (a) of this Article.

المادة 11

أ- تُسحب الأوشحة أو الأوسمة أو الميداليات أو الشارات التي تم منحها بموجب أحكام هذا القانون وتُلغى البراءات الممنوحة على أساسها، بقرار من الجهة المانحة بناءً على توصية المكتب، وبذات الوسيلة التي تم منحها على أساسها، في حال ثبوت ارتكاب الأشخاص الممنوحين لها أي فعل مُخل بالشرف أو الأمانة، أو الإساءة إلى الدولة أو الإمارة أو إلى أي من رموزها، أو اتخذ مواقف مناهِضة لسياساتها أو الدين أو تبنّي أفكار داعمة للتمييز العُنصري وغيرها من الأفكار المناهِضة لمبادئ القانون الدولي أو اتفاقيات حقوق الإنسان والقواعد المقررة من قبل المنظمات الدوليّة. ب- يُقيّد السحب والإلغاء الذي يتم وفقاً لأحكام الفقرة (أ) من هذه المادة في السجل. ج- يتولى المكتب استرداد الأوشحة والأوسمة والميداليات والشارات التي يتم سحبها، والبراءات التي يتم إلغاؤها وفقاً لأحكام هذه المادة، والاحتفاظ بها، وفقاً للسياسات والإجراءات المعمول بها لديه في هذا الشأن.

المادة 12

a. The provisions of Chapter Six of Part One of Book Two of the above-mentioned Federal Law by Decree No. (31) of 2021 concerning the forgery and counterfeiting of seals, marks, and stamps will apply to any person who forges or counterfeits any of the Sashes, Decorations, Medals, or Badges stipulated in this Law; or forges or counterfeits the corresponding Certificates of Recognition. b. The competent court will issue the resolutions and orders for confiscating and destroying forged and counterfeit materials.

المادة 13

With the exception of the resolutions which the Ruler is exclusively authorised to issue under this Law, the Chairman will issue the resolutions required for implementing the provisions of this Law, including approving the policies, procedures, rules, and controls related to Sashes, Decorations, Medals, Badges, and other forms of recognition.

المادة 14

Any provision in any other legislation is hereby repealed to the extent that it contradicts the provisions of this Law.

المادة 15

This Law will be published in the Official Gazette and will come into force on the day on which it is published.
