المادة 1
In addition to the functions vested in it under Article (5) of the above-mentioned Law No. (18) of 2021, the Centre for Amicable Settlement of Disputes (the "CASD") will have jurisdiction to consider and determine the following: 1. applications for the subdivision of property co-owned in undivided shares, excluding Disputes arising from such subdivision where it relates to an Estate; 2. applications for ratification of Conciliation Agreements, irrespective of the value of the relevant claims; 3. Disputes involving claims not exceeding five hundred thousand dirhams (AED 500,000.00), excluding substantive Disputes in which one of the parties is a financial institution to which the above-mentioned Federal Law by Decree No. (14) of 2018 applies; 4. applications for the appointment of experts prior to the initiation of judicial proceedings, where the subject matter of the Dispute falls within the jurisdiction of the Dubai Courts, provided that the Dispute is not already pending before the Dubai Courts or has not been previously determined by a final judicial decision or judgement; 5. Disputes involving claims not exceeding one million dirhams (AED 1,000,000.00) to which UAE Nationals over the age of sixty (60) years are parties; and 6. Disputes involving Persons with Disabilities or Beneficiaries of financial social Benefits under the above-mentioned Law No. (7) of 2012.
المادة 2
The Chief Justice of the Courts of First Instance will assign one or more of the Judges of the Courts of First Instance to undertake judicial supervision of the CASD and to determine the applications and Disputes brought before the CASD in accordance with the above-mentioned Law No. (18) of 2021.
المادة 3
The above-mentioned Resolution No. (8) of 2022 is hereby repealed. Any provision in any other resolution is also hereby repealed to the extent that it contradicts the provisions of this Resolution.
المادة 4
This Resolution will be published in the Official Gazette and will come into force on the day on which it is published.
